Hardware and Software Products
IMPORTANT: BY USING YOUR CMS PRODUCTS BRANDED ITEMS, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF OUR ONE YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.

Limited Hardware Warranty

Subject to the limitations set forth below, CMS Products, LLC. (“CMS”) warrants that its products will be free from defects in materials and workmanship, under normal use and service for one year from the date of purchase from CMS or its authorized resellers.

You may return any new hardware product purchased from CMS that is “dead on arrival” or arrives in damaged condition, for a full refund within 14 days of purchase. CMS  reserves the right to test “dead on arrival” returns and impose a customer fee equal to 15 percent of the product sales price if the customer misrepresents the condition of the product. Any returned product that is damaged through customer misuse, is missing parts, or is in unsellable condition due to customer tampering will result in the customer being charged a higher restocking fee based on the condition of the product. CMS will not accept returns of any product more than 14 days after the purchase of the product.

If a product does not operate as warranted during the applicable warranty period, CMS shall, at its option and expense, (1) repair the defective product or part, or (2) deliver to Customer an equivalent product or part to replace the defective item. All products that are replaced will become the property of CMS. Replacement products may be new or reconditioned. Any replaced or repaired product or part has a ninety (90) day warranty or the remainder of the initial warranty period, whichever is longer. This warranty does not apply to equipment that has been damaged or rendered defective,

  • as a result of accident, misuse or abuse;
  • by the use of parts not manufactured or sold by CMS;
  • by modification without prior written consent from CMS;
  • damage resulting from transit, neglect, power surge or failure, or operating environment; or
  • any event not due to normal wear and tear.
  • Discontinued items

Hard Drives or Flash Drives must not be opened, or warranty will be void. CMS shall not be responsible for any software, firmware, information or memory data of Customer contained in, stored on, or integrated with any products returned to CMS pursuant to any warranty, nor for any consequential damages resulting from the failure of any CMS product or the loss of information resulting from the use of CMS products.

Warranty and return service may be obtained by contacting CMS Support within the applicable warranty period for a Return Material Authorization (RMA) number. Once an RMA number is issued, the defective product must be shipped back to CMS prepaid, insured and wrapped in the original or similar shipping package to ensure that it will not be damaged during shipment. When returning defective product to CMS for service, the RMA number must be marked on the outside of the shipping package. Any product received at CMS not packaged properly may be refused as out of warranty. Physically damaged products will not be processed for warranty.

Any product returned without an RMA number shall be rejected and sent back to the Customer. CMS disclaims any obligation to pay for the shipping of any such returned product, it being understood that the Customer shall bear the cost of returning such products.

BounceBack Backup Software

CMS Products will not refund any activated software licenses. Due to the nature of our software, we do not offer refunds after purchasing an activation code, it is customer’s responsibility to use the trial period to evaluate and ensure that the software is suitable for their needs.
